Acquittal for Simmel
Should Haider be allowed to accuse murderous hate?

Wien / Austria (RNC Agency) 21.08.1996

Johannes Mario Simmel, successful author who accused the right-wing Austrian politician Jörg Haider of murderous incitement to hate had to appear before a Court as a result of a slander summons from Haider. In the first instance of the litigation Simmel was acquitted of the charges brought against him by Haider. According to the News-Agency APA, Simmel`s defence lawyer Walter Schuppich confirmed on Wednesday that the Oberlandgiricht (OLG=County Court) had acquitted Simmel in the slander and libel case. As a result of a Comentary by Simmel in the publication ``News`` in which he said`` Haider perpetrates unscruppulously murderous incitement to hate``. Although a borderline case of legal critic, his statement was acceptable in view of the fact that Simmel had been hounded by the Nazi-Regime and that he had lost relations as a result of the Nazi holocust.
