Last Wednes day legal history was made and a precedent was established by the Czechs legal system, when the owner of a land geust house was called to book and had to answer to charges of Volkerverhetzung (Incitementto hate). Ivo Blahout since 1995 owner of the land geust house``ZELANA`` was alleged to have refused entry to his public geust house to more than 20 persons the half of whom were Czechs and the other Roma. Ondrej Gina a member of the Nationality Council and a well known humanrights campaigner had continuously brought charges of incitement to hate against Blahout who in the presence of the police admitted tha the had refused entry to his pub on racist grounds Andrej Gina stated that he was sick and tired of being refused entry to public establishments because of his race and nationality. In December1995 the district attorney Frantisek Harby brought the case before the district court, but in March the Rokycany city hall threw the case out on the grounds that the charges were a mere breach of the law which should be treatedas such. However, the County Court protested against this ruling andopened criminal proceedings against the offender in the district court where the first public hearing which took place on the 17th July.This of course brought a fully ignored problem to the attention of the public. In his defence Blahout claimed that on the day in question all histables were reserved and added further that Roma were liars and criminals and for this reason were refused entry to his establishment. He said that he was not prepared to suffer loss through theft and damage caused by Roma who mixed under his geusts. Indeed! Blahout managed to present the court with two Roma women as witnesses to his character who told the court that Blahout was a tolerant employer. It was interesting tonote that the women were employed by Blahout shortly before the case against him was opened. Blahout`s lawyer Miroslaw Majer questioned the witnesses for the prosecution in his dazling glossy style with such questions: Have you ever been prosecuted for an offence? Does the man standing before the courtlook like a person who incites to hate? The case was adjourned because a witness who was in the employ of the geust house was on holiday. Jana Sladkova (Judge) saw no reason to object, whilst the District Attorney Ivana Dzurnakova satisfied herself by writing copious notes. It was obvious that the perpetraters of the litigation was the Rokycany Roma Council, who had for years tried to better the

inter-ethnical problems in their city. For example, young members of the Rokycany Roma Council went round public establishments and pubs in theit city with lists and noting with name of place and date.The fact that Blahout was the first to appear in a litigation was more chance than planned as right throughout the city Roma entry is refused. As the Zelana geust house & pub is the leading and finest addressin the gastronome famous for its flair for middle-ages catering and where EU officials and members of the Helsinki-committee of the USA like to meet and the fact that Blahout sees himself as the victim and is convinced that he will win the case, with geusts like Andrej Gina the human rights campaigner, Blahout will be forced to reconsiderhis position with regard to his racist position.
