USA (RNC Agency) 15.01.1997

Kansas City/ Kansas Michael Kolnhofer, 79, who was critically wounded on Dec. 31, made the remarks to senior patrolman Lloyd Whisner, who arrested him forfiring at police, according to the report obtained Tuesday. ''He says,`Why for you shoot me, I not Jew,''' Whisner said in his Jan. 2 report to a police detective. ''He called us Jew bastard and used a lot of profanity towards us.'' Whisner, a 28-year police veteran, told The Kansas City Star that he stood by his report, but he would not verifyits contents. Police spokesman Officer Willie Jenkins said neither he nor his superiors could comment on the report because of an ongoinginvestigation and because the case was being handled by the Wyandotte County prosecutor's office. District Attorney Nick Tomasic also refused to discuss the police report. Kolnhofer is accused of failing to report that he was a guard at death camps in Germany during World War II. His attorney said Kolnhofer was drafted into the German Army but denied working as a death camp guard. The shootout came just after federal officials moved to strip Kolnhofer's U.S. citizenship. He allegedly fired at reporters who gathered outside his home. Kolnhofer, who was charged with three counts of aggravated assault on a law enforcement officer, has been under police guard at the University of Kansas Medical Center since undergoing surgery. During the shootout, a bullet fragment shattered the femur of Kolnhofer's upper left leg and clipped a major blood vessel. ''He is not doing good,'' his friend Anna Hlade said.''He is in a coma. We don't know if he will ever wake up after the surgery.'' Hospital spokesman Van Buckley said he could provide no details beyond listing Kolnhofer in critical condition. The hospital has said Kolnhofer, who is on a respirator, might have suffered brain damage from complications during the surgery. Kolnhofer may not have to face legal action if his condition does not improve, legal expert shave said.
